Reza Khandan on His Wife Nasrin Sotoudeh's Second Court Hearing - "An Acquittal is Highly Unlikely."

for Human Rights in Iran that in his opinion, given that Judge Pir
Abbasi paid little attention to the evidence presented by his wife and
her lawyers during this second court hearing that lasted more than 5
hours, it is highly unlikely that she will be acquitted of the charges
against her.According to The International Campaign for Human Rights in Iran Khandan said the following regarding his wife's court proceedings that took place on Sunday morning: "The Court Hearings were not very promising. Each side only presented their own point of view. It was almost as though the judge and the prosecutor were in one world and Mrs. Sotoudeh and her lawyers in another. Both sides spoke, but an effort was not made to understand the opposing parties point of view. The atmosphere was very uncooperative and given everything my wife has had to go through so far, I am not very hopeful that she will be acquitted of her charges. My only hope at this point is that they grant her bail so that she can come home from prison and recover physically while her sentence is being finalized."
The second court hearing for Nasrin Sotoudeh, lawyer and human rights activist took place on the Sunday November 28th, 2010 at the 26th branch of the Revolutionary Court under the supervision of Judge Pir Abassi and the presence of Sotoudeh's four lawyers. Reza Khandan, Sotoudeh's husband and representatives from the Central Bar Association and the National Union of Lawyers Association were also present during the 5 hour court hearing. Pir Abassi, the judge presiding over this case is to render a final sentence and decide whether or not Sotoudeh's arrest will be overturned by next week.
Reza Khandan described Sotoudeh's physical condition as much better than last week when she was on a hunger strike and added: "Nasrin's lawyers tried very hard to obtain bail, but unfortunately bail was not set today. They also requested that Nasrin be transferred out of solitary confinement, but the judge was not convinced by the arguments they presented and as a result Nasrin was taken back to solitary confinement after the court hearings."
Khandan said the following of Sotoudeh's charges: "The charges were more or less the same as those presented in the first court hearing. They had added membership in the Center for the Defense of Lawyers to her charges during her interrogation. Her lawyers argued today that although under the law membership in such a center is not a crime, Nasrin was never a member of this center. In general Nasrin's case file is very comprehensive this time around and includes all her interviews and her comments to the press, interviews with children and women and her case files."
Khandan said the following with regards to his wife's statements in court today: "They allowed me in the court room 45 minutes after the proceedings had started. By the time I entered the room, Nasrin was speaking her last words. She was complaining about the manner in which prison officials had treated her and explaining that the most difficult aspect of her incarceration was enduring solitary confinement. Nasrin also requested that disciplinary action be brought against one of the prison officials who had insulted her. Nasrin had complained about this incident at the time, however the written reports of her complaint do not appear in any of the case files. We are not sure how to proceed regarding this matter."
Khandan stated that although Mohammad Ali Soltani one of Sotoudeh's four lawyers had presented a comprehensive defense, her lawyers believe that an acquittal is highly unlikely. Khandan added: "Given the way they have dealt with her case since the beginning I doubt she will be acquitted. My only hope at this point is that they grant her bail so that she can come home from prison and recover physically while her sentence is being finalize."
Nasrin Sotoudeh, lawyer and human rights activist was arrested in early September and sent to solitary confinement. Sotoudeh was on a hunger strike (both dry (no food and water) and wet (only water)) during most of her incarceration.

وی «بوی تبرئه: از این پرونده نمی اید.

نسرین ستوده درخصوص برگزاری دادگاه یکشنبه صبح محاکمه همسرش به کمپین بین
المللی حقوق بشر در ایران گفت: « وضعیت دادگاه به گونه ای امیدوار
کننده نبود. هر کدام از طرفین فقط حرف خودشان را می زدند. قاضی و
نماینده دادستان انگار در عالم دیگری بودند و خانم ستوده و وکلایش نیز
در عالم دیگر . حرف می زدند اما هیچ تلاشی برای درک حرف ها صورت نگرفت.
فضای مساحمه وجود نداشت. و به همین دلیل و مجموعه اتفاق های که بر سر
خانم ستوده تا الان آمده است خیلی امیدوار به تبرئه ایشان نیستم. فقط
امیدوارم که قرار بازداشت ایشان به وثیقه تبدیل شود تا حداقل بیرون زندان
بیایند و تا مدت اجرای حکم بتوانند کمی از لحاظ جسمی احیا شوند.»
دومین
جلسه دادگاه نسرین ستوده ، حقوقدا ن و فعال حقوق بشر یکشنبه ، ۷ آذر ماه
در شعبه ۲۶ دادگاه انقلاب با حضور قاضی پیرعباسی و ۴ وکیل خانم ستوده
برگزار شد. در این جلسه که بیش از ۵ ساعت طول کشیده رضا خندان ، همسر این
حقوقدا ن و نمایندگان کانون وکلا و اتحادیه سراسری کانون وکلا نیز حضور
داشتند. صدور حکم بدوی و تعیین رضایت بر تبدیل قرار بازداشت نسرین ستوده
به وثیقه نیز هفته آینده مشخص می شود.

توصیف کردن وضعیت جسمی و روحی نسرین ستوده نسبت به هفته گذشته که در
اعتصاب غذا بود در خصوص جلسه امرزو گفت: « وکلای نسرین تلاش کرده بودند تا
قرار بازداشت او به وثیقه تبدیل شود اما امروز این اتفاق نیفتاد .همین
طور وکلایش خواستند که انفرادی او قطع شود اما قاضی با دلایلی که آنها می
آورد قانع نشد و دوباره نسرین به انفردای برگشت.»
همسر
نسرین ستوده در خصوص اتهامات وارد شده به نسرین گفت: « عنوان کلی
اتهامات همان قبلی ها بود به جز اینکه عضویت در کانون مدافعان وکلا نیز
در مرحله از بازجویی به آن اضافه شده بود. وکلایش نیز امروز گفتند که
اگرچه اساسا عضویت در این کانون از نظر قانونی جرم نیست اما اصلا نسرین
عضو این کانون نبوده است . به طور کلی پرونده نسرین این بار بسیار قصور
است و شامل تمام مصاحبه ها و حرف های او در مطبوعات در زمینه مصاحبه با
کودکان و زنان و پرونده هایش نیز می شود.»
رضا خندان در
خصوص حرف های ستوده در دادگاه امروز گفت : «من را با ۴۵ دقیقه تاخیر راه
دادند بنابراین وقتی وارد اتاق شدم به حرف های آخر نسرین رسیده بودم .
نسرین از نحوه رفتار ماموران زندان با خودش شاکی بود و بزرگترین فشارش را
دراین مدت بودن در سلول انفرادی دانست. همچنین پیگیرشکایت خود از یکی از
ماموران زندان شد که چندی پیش به او توهین کرده بود. نسرین همان موقع
شکایت می کند اما برگه های شکایت الان در هیچکدام از پرونده هایش نیست و
ما نمی دانیم دنبالشان را از کجا گرفت؟»
رضا خندان با اشاره
به اینکه محمد علی سلطانی به نمایندگی از وکلای دیگرمتن دفاعیات نسرین
را خواند و گفت: «بوی تبرئه نمی آمد . از مجموعه برخوردهای که از ابتدا
تا الان با خانم ستوده شده است به نظرم تبرئه نمی شود تنها آرزو دارم که
با قرار وثیقه آزاد شود تا بتواند تا روز دادگاه و رفتن دوباره به زندان
از لحاظ جسمی و روحی کمی روی خودش کارکند.»
نسرین ستوده ،
حقوقدان و فعال حقوق بشر اواخر شهریورماه امسال بازداشت و تمام این مدت
را د ر بند انفرادی بوده و بیشتر روزهایش در اعتصاب تر یا خشک گذشته است.
